I have a question about 1099's that I'm hoping someone can answer.

If my business is non-U.S.-based and I have worked with independent contractors that are in the U.S., do I have to fill out a 1099 for them?

Likewise, if I'm U.S.-based, should I assume I do not have to send a 1099 for someone who is non-U.S.-based?

Any comments and suggestions you can offer are very much appreciated.

Hi, Heidi:
Good questions! Here are short, but sweet answers for your tax-forms future!

To answer your first question, as a foreign company (a.k.a. a non-U.S. based company), you only issue 1099's for services performed in the U.S. by independent contractors in the U.S.

To answer your second question, U.S. businesses do not have to complete 1099's for non U.S. residents (independent contractors) unless they perform the work here in the United States.

Peter Soh answered a question back in Feb
2001 regarding if a non-US company, hires an
idependent contractor that you need to file a
1099 for services performed in the US. My
question is how does this non-US company
file the 1099 with US, since this company
does not file taxes in the U.S??
