Currently I am in the process of starting a clothing company and I want to protect myself from buyers who might cancel orders that they place with me. So, I wanted to make up an agreement that buyers have to cancel orders within 20 days if they don't want my merchandise. I thought maybe this type of agreement would protect me financially if buyers ever decide to cancel orders with me at the last minute. So is this a good thing to do or not ? I really need help!!

I have contract forms that talk about this same thing for my web site design/hosting business and I find the contract doesn't really mean too much. If they cancal and my job is only a few hundread dollors it is not worth going to court of anything like that. This is why I require a deposit up front. I quote each job indivuidually, along with the required deposit. I usualy ask for at least 30%, but I believe I'm going to start to require 50% upfront.

A big factor is going to probably be how much the items cost, and/or your time to make or modify them.

What I've seen on order forms is that any order placed can only be cancelled within X number of days from when the order was written, for instance 10 days. Thereafter, the order will be shipped and if returned, you will assess restocking fees, a handling charge, and the shipping fees it costs the designer to send out the package.

Most buyers who overspend their budget will try to return merchandise when it comes in saying it was damaged or some other reason. After racking up all of these fees, they will be more careful about ordering.

Most importantly, put it in writing on your form in bold print so that the buyer will clearly see your terms.

I am a sort of store owner. I have found that many start-up clothign stores go out of business quickly. If you find it difficult to make sales try to get into some better know shops by placing you clothing on consignment. This may boost your sales and make it easier to get placement elsewhere.
